Gwinnett County officials have indicated that the county is no longer considering TDRs for possible implementation after hearing from its leagal council. The county had hoped to use TDRs as tool for conservation efforts and lower densities in undeveloped and low-density areas of the County, while spurring development and redevelopment in higher density areas of the County. However, due to the language of the state law governing TDRs it appears that such tools are not likely to be as effective as needed. The county has indicated that for such a program to work changes in state law are required. Of particular issue is restrictions on density levels in the receiving areas to no more than that which is allowed by the current zoning.
